The plaintiff claims Foxx took her to a secluded area, groped her breasts and assaulted her under her pants against her will. The incident occurred at Catch NYC, where Foxx and the bar’s owner, Mark Birnbaum, were present. The lawsuit alleges that Foxx complimented the plaintiff, comparing her beauty to Gabrielle Union, before assaulting her on the rooftop. She claims that a security guard was present and able to see the incident until a friend arrived and Foxx stepped back. The victim is seeking compensation for pain, suffering, emotional distress, anxiety and humiliation. The lawsuit also names Birnbaum and Catch NYC, claiming they enabled the assault.
